PUBLIC NOTICE

The Tanzania Shipping Agencies Corporation (TASAC), was established under Section 4 of the Tanzania Shipping Agencies Act, Cap. 415 as a maritime administration to oversee maritime safety, security, environment and regulator of maritime transport services. In executing its mandates as regulator of maritime transport services, the Corporation is charged with the function of licensing and registering regulated service providers in the maritime transport sector, among others, in accordance with section 12 of Cap. 415.

The Corporation is hereby inviting interested companies and existing licensees to apply for licensing and registration or renewal of licence and registration in accordance with the Act and its Regulations as follows:

INVITATION OF APPLICATIONS FOR:

1.NEW LICENCE AND LICENCE RENEWAL OF:

i)SHIPPING AGENTS;

ii)CARGO CONSOLIDATORS & DE-CONSOLIDATORS; AND

iii)MISCELLANEOUS PORTS SERVICES (MPS).

2.REGISTRATION OR RENEWAL OF REGISTRATION OF:

i)CLEARING AND FORWARDING AGENTS; AND

ii)GROSS MASS VERIFIERS.

Applications for the above-mentioned licences/registration or renewals are invited in accordance with the Act and the following respective Regulations:

  • 1.Tanzania Shipping Agencies (Shipping Agents) Regulations, (GN. No. 339 of 2018);
  • 2.Tanzania Shipping Agencies (Cargo Consolidators and De-Consolidators) Regulations (GN. No. 337of 2018);
  • 3.Tanzania Shipping Agencies (Miscellaneous Port Services) Regulations (GN. No. 343 of 2018).
  • 4.Tanzania Shipping Agencies (Clearing and Forwarding Agents) Regulations (GN. No. 340 of 2018); and
  • 5.Merchant Shipping (Verified Gross Mass of a Container Carrying Cargo) Regulations (GN No.197 of 2016).

Prospective applicants for licences/registration are guided to submit their applications by filing-in prescribed forms online after obtaining a link from TASAC Head Office or Regional Offices, while applicants for renewals are guided to login in their previous accounts and update their information as necessary. Every applicant must enclose certified copies of relevant documents as shown below:

1.SHIPPING AGENCY LICENCE

i)Certificate of Incorporation in case of new applicant;

ii)Agency fees and commissions payable by principals to the applicant, which comply with the Tanzania Shipping Agencies (Shipping Agents) Regulations, 2018;

iii)Share Certificates of named shareholders to confirm ownership in case of new applicants or where there is change of a shareholder for renewals;

iv)Principal – Shipping Agent Agreement/Contract, where the principal operates regular liner services;

v)Commitment letter to furnish to the Corporation with copies of charter parties or agency terms for each vessel handled where a principal operates tramp services;

vi)Latest Bank Statement for renewing agents;

vii)Birth Certificates/affidavit of shareholders and employees for new applicants or where a renewing agent has changed a shareholder or employee;

viii)Evidence of professional staff possessing appropriate qualifications in accordance with provisions of the Tanzania Shipping Agencies (Shipping Agents) Regulations, 2018;

ix)Valid business licence for renewing agents;

x)Tariffs/ charges to be applied for services to be rendered in 2023, which conform to the approved tariffs;

xi)Valid Tax Clearance Certificate;

xii)Latest Audited Accounts in case of application for renewal;

xiii)Annual Returns showing Shareholders with respective percentage of ownership as well as the Directors in case of application for renewal;

xiv)Previous Shipping Agency licence in case of application for renewal;

xv)Memorandum and Articles of Association in case of new applicant;

xvi)Lease agreement or proof of occupancy of land of the office premises in case of new applicant or where previous lease agreement is expiring;

xvii)Affidavit of Shareholders and Directors on Eligibility for license as per Regulation 5 of the Tanzania Shipping Agencies (Shipping Agents) Regulations, 2018;

xviii)Customer care handling procedures including customer inquiries and complaints handling system;

xix)Proof of Information and Communication Technology (ICT) applications relevant to shipping agency business in case of new applicant; and

xx)Evidence of payment of licence application fees;

NB:Please take note that for shipping agency application should be submitted not later than 31st October, 2022.

2.MISCELLANEOUS PORT SERVICES LICENCE

i)Memorandum and Articles of Association in case of new applicant;

ii)Certificate of Incorporation/Compliance as the case may be;

iii)Valid business licence;

iv)Tax Clearance Certificate;

v)Share certificates of company shareholders;

vi)Proof of business premises;

vii)List of available cargo handling equipment and gears;

viii)Customer care handling procedures including customer inquiries and complaints handling system;

ix)List of available safety gears and personal protection equipment for operational workers; and

x)Evidence of payment of application fee.

3.CARGO CONSOLIDATORS AND DE-CONSOLIDATORS LICENCE

i)Certificate of Incorporation in case of new applicant;

ii)Valid insurance cover for third party liability;

iii)Valid fire and safety certificate;

iv)Proof or availability of business premises, including customs bonded area or warehouse;

v)Valid Tax Clearance certificate;

vi)Proposed rates and charges including transit rates which conform to the approved tariffs;

vii)List of names and addresses of local and foreign counterparts;

viii)List and proof of available cargo handling equipment owned or available on outsourcing arrangements;

ix)List of ICT facilities;

x)Previous Cargo Consolidator/ De-Consolidator licence in case of renewing applicant;

xi)Proof of existence of cargo tracking system;

xii)Latest Bank Statement;

xiii)Proof of qualified staff in compliance with the Cargo Consolidators and De-consolidators Regulations, 2018;

xiv)Customer care handling procedures including customer inquiries and complaints handling system; and

xv)Evidence of payment of application fee.

4.CLEARING AND FORWARDING AGENTS CERTIFICATE

i)Certificate of incorporation or certificate of compliance, as the case may be;

ii)Memorandum and articles of association in case of new applicant;

iii)Valid business licence;

iv)Lease agreement or proof of ownership of the premises where the applicant’s office for clearing and forwarding agency is located;

v)Proof of ICT applications by the applicant for clearing and forwarding agency;

vi)Customer care handling procedures including customer inquiries and complaints handling system;

vii)Valid Tax Clearance Certificate;

viii)Evidence of payment of application fees set out in the Third Schedule to these Regulations;

ix)Proof of qualifications of staff in compliance with the Clearing and Forwarding Agents Regulations, 2018; and

x)Evidence of payment of application fees.

5.GROSS MASS VERIFIERS CERTIFICATE

i)Valid Business licence;

ii)Certificate of Incorporation in case of new applicant;

iii)Valid calibration certificate of the weighing equipment issued by the Weights and Measures Agency;

iv)Tariff rates/charges to be applied; and

v)Evidence of payment of application fees.

The Tanzania Shipping Agencies Act, Cap. 415 and its Regulations are available on the TASAC website (www.tasac.go.tz). Applicants are advised to access the legislation for detailed guidance on requirements for licence application and conditions of licence in order to ensure full compliance.

The Corporation may publish names and other details of applicants for licence, registration or renewals to enable members of the public and stakeholders to provide information to TASAC which may enable the Corporation to make appropriate determination of qualification of an applicant for licence or registration.
